GENERAL QUESTIONS
How long has Capital Hungary been in the property business in Budapest?
The company was founded some four years ago, and our managing directors each have vast real estate experience in Hungary and other countries.
With the HQ being in Budapest, will I be able to communicate in English?
Yes. Our call centre staff are all English speaking as well as some other languages. In the office in Budapest, even though the majority of staff is Hungarian, all communication can be held in English. Mortgage advice, legal advice, and property management information can all be given in English as well.
How many foreigners are buying investment property in Budapest?
The numbers are constantly increasing as more and more people find out about the great investment potential of Budapest. Last year some 4.000 foreigners and 12.000 locals invested in property in Budapest.
Do you charge the client any fees or commissions when purchasing through Capital Eyes?
When buying a new-build property, no buyer fees are charged to the client. Capital Eyes will receive a commission from the developer for marketing and selling their project. When purchasing a classical apartment, a small buyers fee of 3% plus VAT will be charged to the client as a administration fee, as the process becomes more complicated. On special turn-key investment projects, a finders fee will be charged depending on each individual investment-deal.
Does Capital Eyes operate in any other markets apart from Budapest?
Yes, Capital Eyes International, part of the Capital Eyes Group, also operates in Berlin, Bulgaria, Turkey, and soon Panama. We are always researching new, exciting and emerging areas for property investments and always make sure our clients know all about it first.
How many staff are employed by Capital Eyes?
The Capital Eyes Group counts approximately 50 members of staff.
LEGAL QUESTIONS
What are solicitor’s fees?
Generally the solicitor charges 1% - 1,5% for doing the purchase contract.
Are contracts in English?
Yes. All contracts, the Power of Attorney and the Technical Description are bilingual – in Hungarian and English.
Do I have to use a Hungarian solicitor?
Yes. For completing a Hungarian real estate transaction, a Hungarian solicitor must be used.
Who pays the solicitor?
The solicitor is generally paid by the buyer of the property.
Can I buy a property on my own name?
Yes. As a foreign national, you will need a written approval from the Administrative Office of Budapest, but this is a simple buerocratic procedure completed by your solicitor.
How many properties can I buy on my own name?
3 are usually no problem. If you are planning to buy more, we recommend either involving your immediate relatives or setting up a Hungarian company.
Do I have to travel to Hungary?
Not necessarily. Legal documents can be signed at the Hungarian embassy in your country or in front of a public notary and then appostilled by a relevant authority. However, if you are purchasing the property with a Hungarian loan or if you are setting up a Hungarian company to purchase with, then you will have to travel to Hungary for opening a bank account.
Are solicitors insured?
Yes. All Hungarian solicitors have to be insured.
What happens if the developer goes bust?
The developments are generally financed by a local bank. You as a purchaser will be paying only as much as the construction progresses. In case the developer goes bankrupt, the bank will take over the development and will appoint a new developer (subcontractor) to complete the development.
What if I make my mind up after signing the contract?
You will lose the downpayment (generally 10% of the purchase price).
What if the developer cancels the contract after signing?
If the developer cancels the contract due to a fault attributable to him, then he will have to pay you back double the amount of the downpayment.
What if the developer does not complete on time?
There are usually penalty payments for set period of delay, then after a period of time you have the right to terminate the contract and claim double the downpayment from the developer.
What if I do not pay on time?
There are usually penalty interest payments for a set period of delay, then after a period of time the developer has the right to terminate the contract and keep the downpayment.
When is the new buyer registered on the title sheet?
Upon signature of private sale-purchase contracts. (This is important, since you do not have to wait until completion.)
Is it an independent solicitor?
Yes. The solicitor’s we recommend are fully independent from Capital Eyes and you – as the purchaser – contracts them to represent you in the transaction.
Can I resell the property before completion?
This depends on the development. Some developers will allow for reselling before completion, some will not. Please ask your property consultant for an answer to this question relating to the property you are interested in!
Do I need to make a will in Hungary?
No. According to Hungarian law, the inheritance laws applicable in your home country apply.
Are properties freehold?
Yes, most of the properties in Budapest are freehold, where in addition to your apartment, you also own a proportion of the common areas / land.
TAX QUESTIONS
How much is the Property Transfer Tax / Stamp Duty?
In case of new properties, until 60,000 EUR nothing, then 6% on the amount above. If the property price exceeds 120,000 EUR, then 6% on the WHOLE amount. In case of classical properties, 6% on the whole amount. In case of commercial properties, 10%.
How much is Capital Gains Tax?
In case of private purchase, 25%. After the 5th year, this tax is reduced by 2% yearly, so after 15 years it is 0.
In case of buying through a company, 20% (16% corporation tax + 4% solidarity tax).
How much is corporation tax?
16% + 4% solidarity tax.
How much is Income Tax?
25%.
Can I offset my interest repayments against my rental income?
Only in case of commercial properties.
Can I offset VAT against my rental income?
Only in case of commercial properties.
What is the tax on rental income?
25%.
How much do I have to pay for an accountant / annum?
The accountant’s fees are around 400 EUR / year.
How much are the Property Rates/Local Tax?
There are no rates or property tax for residential property in Hungary.
Do I have to pay taxes two times – once in Hungary and once in my own country?
There is a double taxation agreement between Hungary and the UK, Ireland, Spain… This means that you will not have to pay the same % tax twice. You need to pay taxes FIRST in Hungary, and if there is a difference, then that should be paid in your country of residence.
FINANCING QUESTION
Can I get a mortgage in Hungary?
Yes! Now mortgages are available for non-residents.
How much can I borrow / What is the loan to value?
You can borrow up to even 80% of the property value, but each transaction is separately evaluated by the bank. Generally 70% is available for new development apartments. Generally 50% - 60% is available for classical apartments.
What is the duration of the loan?
20-25 years are available.
Can I get a mortgage if I buy through a company?
Yes, you can get leasing financing through a local company.
What is the interest rate?
Approximately 5.5% (Swiss Frank based loan – base rate + 3 - 3.5%).
What is the fee for getting a mortgage?
2%.
How long does it take to organize a mortgage?
Approximately 2 months.
What documents are required from me?
- Payslips - These loans are salary based loans, so you will have to prove your incomes. (for the past 6 months)
- P60
- Tax Report for the self employed.
- Bank Statements (for the past 6 months)
- Credit Bureau / Reference – proof of no public debts / liabilities
(The documents relating to the property can be obtained from your Hungarian solicitor.)
- Employment Statement – If you are employed, this is a statement from your employer.
What is the currency of the loan?

Is there an age requirement?
The loan period must end before you turn 70.
Are there interest-only loans?
Yes, there are such opportunities, but check for the property you are purchasing if this is available.
Are there residial-value loans?
Yes, there are such opportunities, but check for the property you are purchasing if this is available.

What is the mainenance fee on an apartment and who pays it?
The general maintenance charge comes out at around 0.7 EUR / sqm (1 bedroom 40 sqm apartment = approximately 28 EUR / month)
How are the common areas maintained, the old buildings renovated?
Every owner must pay the common costs every month (this is generally paid by the tenant if the apartment is rented out) and within this amount there is an allowance for a “renovation fund“, from which restorations are done.
